BrushO User Agreement
1. Introduction
Welcome to BrushO, the smart toothbrush and related services (hereinafter referred to as BrushO). BrushO is operated by DeIoT Labs Foundation, dedicated to helping users develop good brushing habits and enhance their oral health through innovative smart technology and community collaboration, ultimately improving overall quality of life. We believe that a healthy mouth is a cornerstone of a happy life. BrushO's vision is to incentivize users to actively participate in oral care through a decentralized approach, fostering good health habits and creating a healthier and more vibrant future together. By purchasing a BrushO toothbrush and registering as a user on the official BrushO website (https://brusho.com), you (hereinafter referred to as you or user) agree to be bound by all the terms and conditions of this User Agreement. If you do not agree to this User Agreement, you may choose not to register as a BrushO user and only use the BrushO physical product.
2. Definitions
User: An individual who purchases BrushO products and registers on the official BrushO website, including but not limited to users who participate in platform governance, utilize platform functions, and engage in incentive activities.
Platform: Refers to BrushO and its related services, websites, and applications, including all online and offline functionalities associated with BrushO.
Smart Contract: A blockchain technology protocol used on the platform to perform automated operations, ensuring decentralized decision-making and the execution of incentive mechanisms.
3. User Eligibility
This platform does not accept registration from individuals who are U.S. nationals, reside in the United States, or are under 18 years old. If we discover any accounts registered in violation of the above eligibility requirements, we reserve the right to suspend or terminate your account at any time and cancel related services and benefits.
You represent and warrant that all information provided during registration is true, accurate, and complete, and will be promptly updated in the event of any changes. Incorrect or inaccurate information may result in your inability to access or use certain platform features.
4. Account Registration and Security
We will require you to provide a valid email address for registration purposes. This email address will be used solely for registration verification. You must log into the corresponding email address to complete the verification process and register your account. Users who do not complete email verification will be unable to register their accounts and will not be able to enjoy the services provided by the platform.
You are responsible for ensuring the security of your registration information, including but not limited to maintaining the strength of your password and not sharing account information with third parties. We recommend regularly changing your password and using secure password management tools.
If you suspect that your account information has been compromised or is being used without authorization, you should immediately notify BrushO. We will not be liable for any losses resulting from your failure to provide timely notice.
5. Data Use and Privacy
BrushO does not collect or store users' brushing data or any health data generated from brushing. At this stage, all data is stored locally by the users on their own hardware, and BrushO cannot access or control this data. Users who voluntarily share their brushing data to help improve BrushO products and services will sign a separate Data Sharing and Privacy Agreement, outlining the rights and obligations of both parties. In the absence of shared data, users are only required to register with an email address, and no other personal information will be collected. All personal data collection, use, and storage strictly adhere to the provisions of the Privacy Policy, which users may consult at any time.
6. User Code of Conduct
Users are required to comply with the following code of conduct while using the BrushO platform. Any violations may result in account suspension or termination:
Users are prohibited from publishing, distributing, or sharing any illegal, obscene, insulting, offensive, or false information and must not harass, defame, or attack others.
Users may not collect, store, use, or share other users' data or information without authorization. Any form of data misuse will result in immediate account termination.
Users are prohibited from interfering with, disrupting, or attempting to breach the normal operation of the BrushO platform or its related services in any way, including but not limited to spreading malicious software, conducting DDoS attacks, or engaging in other disruptive activities.
Users must comply with all data privacy and security policies and may not handle or share data in ways that violate the privacy policy.
Users are prohibited from using the BrushO platform to send spam, advertising information, or any form of unauthorized marketing activities. Any misuse will result in the disabling of the user's account.
7. Intellectual Property
All content on the platform, including but not limited to text, images, audio, video, digital downloads, data compilations, code, and software, is owned by BrushO or its licensors and is protected by copyright, trademark, patent, and other intellectual property laws.
Users are granted a limited license for personal, non-commercial use of BrushO content. Users may not copy, modify, distribute, republish, or use the content to create derivative works without prior written authorization from BrushO.
Any user-generated content (e.g., comments, feedback, suggestions) submitted to the platform will be considered as granting BrushO a perpetual, global, irrevocable, non-exclusive license to use, display, distribute, modify, promote, and improve BrushO services without compensation.
8. Limitation of Liability
Services As-Is: BrushO and its related services are provided as-is without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the continuity, uninterrupted operation, or faultlessness of the platform services.
Risk Assumption: Users explicitly understand and agree that all risks arising from the use of BrushO services (including but not limited to technical risks, operational errors, market risks, etc.) are solely borne by the user, and the platform is not responsible for the user's investment, use, or participation activities.
Loss Compensation: Under no circumstances will BrushO, its affiliates, employees, agents, or representatives be liable for any direct, indirect, special, punitive, or consequential damages resulting from the use or inability to use the platform, including but not limited to data loss, profit loss, business interruption, or other economic losses.
Third-Party Liability: Any third-party websites or resources accessed through platform links are the responsibility of the respective third parties. BrushO assumes no responsibility for the content, services, or privacy policies of third-party websites or resources, and users must independently assess the authenticity and security of third-party content.
9. Risk Disclaimer
Using the BrushO platform and its related services involves various risks. Users must fully understand these risks and continue using the platform at their own risk. Key risk explanations are as follows:
Technical Risk: BrushO operates on blockchain technology, which may contain technical defects or vulnerabilities, such as smart contract code errors, consensus mechanism defects, blockchain network congestion, hard forks, or other technical issues. Cyberattacks, malware, or other network attacks may result in data loss or account breaches.
Regulatory Risk: The regulatory environment for digital assets and blockchain technology is constantly evolving, which may result in BrushO being restricted, banned, or subject to additional compliance requirements in certain regions. Users should understand and comply with the relevant laws and regulations in their jurisdiction. BrushO assumes no responsibility for any impacts or losses caused by legal changes.
Legal and Compliance Risk: As the legal understanding and regulatory measures of blockchain and digital assets vary across countries, users must independently assess the legal compliance of participating in the project. Any risks arising from legal or compliance issues are borne solely by the user.
Smart Contract Risk: Smart contracts are a critical component of the platform, responsible for executing automated operations and transactions between users. Smart contracts operate entirely based on code logic and cannot be altered or revoked once deployed. Users must fully understand the mechanisms and potential risks of smart contracts. If smart contract code contains errors or is maliciously exploited, it may result in financial loss or transaction failure. BrushO cannot intervene or fix issues within smart contracts, and users bear the related risks.
Operational Risk: Any user errors while using the platform (such as transferring to an incorrect address, not backing up keys) may result in permanent loss of funds. BrushO cannot recover or compensate for any losses resulting from user mistakes.
10. Smart Contract Terms
Smart contracts are essential tools for implementing automated operations on the BrushO platform, ensuring decentralized management and transparent incentive mechanisms through blockchain technology. The main contents of the smart contract terms are as follows:
Definition and Function of Smart Contracts: Smart contracts are self-executing agreements deployed on blockchain networks in code form, used to automate specific tasks such as reward distribution, vote counting, transaction settlement, etc. Once deployed, smart contracts operate automatically according to code logic without human intervention.
User Responsibilities and Risks: Before using smart contracts, users must fully understand their principles and operational procedures. Any losses due to misunderstanding contract terms, improper operation, or erroneous judgments regarding smart contract code logic are solely borne by the user. Users must ensure the accuracy of their transactions, including but not limited to entering the correct address, amount, and operation parameters. The platform assumes no responsibility for any losses resulting from input errors or non-compliant operations.
Immutability and Irrevocability: Once deployed, smart contracts cannot be changed, revoked, or stopped. All transactions or operations conducted within the smart contract are irreversible. Users bear full responsibility for the consequences of their actions. Contract changes can only be made through new contract deployments and community voting decisions, with funds and data in the original contract not automatically migrating to the new contract.
Security and Vulnerability Risks: Although BrushO strives to ensure the security of smart contracts, it cannot entirely eliminate vulnerabilities or attack risks within smart contract code. Users must acknowledge and accept the associated risks of financial loss or service disruption. The platform assumes no responsibility for any vulnerabilities, errors, or exploited behaviors within smart contracts. Users should take security measures, such as reviewing contract code and using audited contracts.
Audit and Transparency: BrushO will, whenever possible, commission third-party auditing agencies to audit smart contract code and publish the audit results to enhance the security and transparency of smart contracts. Even if a contract has been audited, undiscovered vulnerabilities may still exist. Users should stay updated on community announcements and security alerts.
Limitations of Smart Contracts: The functionality of smart contracts is limited to the written code logic and cannot handle situations outside the code. BrushO is not responsible for any operational failures or losses caused by the limitations of smart contract functionality. Smart contracts cannot directly interact with off-chain resources (such as real-world data or payment systems), and users should carefully assess the feasibility of contract execution.
11. Termination and Suspension
BrushO reserves the right to suspend or terminate user accounts and services immediately under the following circumstances: actions in violation of this Agreement, platform rules, or applicable laws; suspected fraud, abuse, or other improper use of the platform.
Upon termination of a user account, the user will no longer be able to use platform services and functions. Users are fully responsible for any impact and losses resulting from account termination.
12. Amendment of Terms
DeIoT Labs Foundation reserves the right to amend the terms of this Agreement. Amended content will be published on the BrushO official website and take effect immediately upon publication. Users are encouraged to review this Agreement regularly, and continued use of the platform constitutes acceptance of the amended terms.
13. Governing Law and Dispute Resolution
This Agreement is governed by the laws of Hong Kong, and any disputes arising from or related to this Agreement shall be submitted to the Hong Kong International Arbitration Centre for arbitration. The arbitration award shall be final and binding on both parties.
